As part of the Association’s continuing efforts to improve safety and security within our community, the Village at Gum Springs has established a formal No-Trespassing Agreement with the Fairfax County Police Department (FCPD).
This agreement gives FCPD officers authorization to act on the Association’s behalf when addressing unauthorized individuals on Association-owned common property. When appropriate, officers may direct an individual to leave the property and take trespass-enforcement action without requiring a Board member, property manager, or other Association representative to be physically present at the time of the incident.
Establishing this authority required substantial coordination with Fairfax County and FCPD. The language and enforcement procedure were reviewed and approved through the County’s prosecutorial authorities before the agreement could be implemented. We are pleased that this process has now been completed and that the agreement is formally in place with FCPD.
The agreement provides officers with an additional tool to address individuals who have no legitimate purpose for remaining on Association property, particularly when their conduct is creating safety concerns, disturbing residents, or contributing to unlawful or disruptive activity. It also allows officers responding to calls within the community to address trespassing situations directly rather than requiring the Association to locate a representative and send that person to the scene before action can be taken.
This agreement does not change residents’ or their invited guests’ normal right to use Association common areas in accordance with community rules. Its purpose is to give law enforcement a practical and effective mechanism for addressing unauthorized persons when circumstances warrant.
The Association appreciates the cooperation of the Fairfax County Police Department and County officials who worked with us to put this additional community-safety measure in place.
