Owners are permitted to lease their homes, but rentals must be handled in a way that protects the residential character of the community and ensures that tenants understand and follow the same rules that apply to homeowners.
Leases must be in writing and must comply with the Association’s governing documents, rules, and applicable Fairfax County requirements. Short-term, transient, hotel-style, or revolving occupancy is not permitted, and the initial lease term must be at least six months.
In general, the entire dwelling must be leased rather than individual portions of the home. The Association’s governing documents also contain specific requirements regarding roommates, occupancy, lease terms, and tenant responsibilities.
Owners are responsible for making sure their tenants receive and understand the Association’s governing documents, current rules, and policies. Tenants, their family members, guests, and invitees are expected to comply with those requirements in the same manner as any other resident.
Owners must also provide the Association or management with the required lease documentation and tenant registration information, including vehicle information, within the timeframes established by the Association.
An owner who is not occupying the home must keep current off-site contact information on file with the Association so that management can reach the owner when necessary.
Owners also remain responsible for damage to the Common Area caused by their tenants, their tenants’ family members, guests, invitees, or others associated with the tenancy.
Tenants are expected to use the property for residential purposes and may not engage in activities that create a nuisance, unreasonably interfere with neighbors’ quiet enjoyment, or otherwise violate the Association’s governing documents or rules.
Violations by a tenant may also constitute a violation by the owner and may be addressed through the Association’s established enforcement procedures. In serious or continuing cases, the governing documents provide the Association with additional remedies relating to lease violations.
Owners considering renting their home should review the Association’s governing documents and current rental policies carefully for the complete requirements, including lease terms, registration procedures, occupancy limitations, required lease language, tenant responsibilities, parking requirements, and enforcement provisions.
The goal is not to discourage responsible rentals. It is to ensure that leased homes remain subject to the same community standards and expectations that apply throughout the Village at Gum Springs.
